These terms cover your use of the DIRT website at dirttrades.com and any communications you initiate through it, including our SMS text message program. By using the site or submitting your contact information, you agree to these terms.
"DIRT," "we," "us," and "our" mean DIRT Trades DBA, the operator of dirttrades.com.
Accepting these terms
If you use this site or submit your contact information through it, you accept these terms and our Privacy Policy. If you don't agree, don't use the site. If you're using the site for a business, you confirm you're authorised to agree on its behalf.
About DIRT
DIRT is a voice-first profit tracking and invoicing app for contractors, available now on the iPhone App Store and on the web at app.dirttrades.com. Anything on this site describes features as they currently exist or are in development. Product details can change without notice.
Text message program
By submitting your phone number via our website contact form and checking the opt-in box, you expressly consent to receive SMS text messages from DIRT regarding appointments, reminders, schedule updates, and information about DIRT products and services. Message frequency may vary. Message and data rates may apply.
- To cancel: Reply STOP to any message. We will send one confirmation SMS and then stop all texts to that number. To re-enroll, submit the contact form again.
- For help: Reply HELP to any message, or email get@dirttrades.com.
- Carriers are not liable for delayed or undelivered messages.
- For questions about your text or data plan, contact your wireless provider.

Acceptable use
When you use the site, you agree not to:
- Break the law or use the site for anything illegal.
- Submit someone else's phone number or email without their permission, or give false information.
- Try to break into, overload, scrape, or interfere with the site or the systems behind it.
- Copy, resell, or misuse the site's content or the DIRT name and brand.
Intellectual property
The DIRT name, wordmark, brand, page content, and the look and feel of the site are owned by DIRT Trades DBA and protected by law. Using the site doesn't give you any right to use our name or brand. Don't use them without our written permission.
No warranty
The site is provided "as is" and "as available," without warranties of any kind, whether stated or implied. We don't promise the site will always be available, error-free, accurate, or secure. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent the law allows, DIRT Trades DBA is not liable for any indirect, incidental, special, or consequential damages, or for any lost profits or lost data, arising out of your use of the site or the early-access list. The site is free to use and pre-launch; our total liability for any claim related to the site is limited to the amount you paid us to use it, which is zero.
Changes to these terms
We may update these terms as the product grows or the law changes. When we do, we'll change the effective date at the top. If you keep using the site after a change, you accept the updated terms.
Governing law
These terms are governed by the laws of Texas, without regard to its conflict-of-laws rules. Any dispute related to the site or these terms will be handled in the courts located in Texas.
